Terms and conditions
The agreement between you and COTHM Dubai when you enrol on a programme — enrolment, fees, how teaching is delivered, certification, and the limits of what we undertake.
- Last updated
These terms govern your enrolment with COTHM Dubai. By submitting an application, accepting a place or paying any fee, you agree to them. Please read them with the refund policy and the cancellation and deferral policy, which form part of the same agreement.
1. Who you are contracting with
COTHM Dubai is a private training institute regulated by the Knowledge and Human Development Authority (KHDA), Dubai, United Arab Emirates. In these terms “the institute”, “we” and “us” mean COTHM Dubai; “you” means the person enrolling, or the parent or guardian where the enrolling student is under eighteen.
Where a programme is delivered under the name of an awarding body — ICM UK, AHLEI, Qualifi UK, Highfield UK, IATA or KHDA Dubai — that body sets and awards the qualification. Your contract for tuition is with the institute. Your qualification is awarded by the body, on that body’s own terms, which are set out in our certification terms and policies.
2. Enrolment
An application is an offer to enrol. You are enrolled only when we confirm your place in writing and the fees due at enrolment have been received.
We may decline an application, or withdraw an offer, where entry requirements are not met, where documents cannot be verified, or where a programme does not run. Entry requirements for each programme are published on its page and on entry requirements.
You are responsible for the accuracy of what you tell us. Where a place or a certificate has been issued on the basis of information that proves to be false, we may withdraw it.
3. Fees and payment
Fees are stated in UAE dirhams (AED) and are published on the fee schedule and on each programme page. Unless we have agreed otherwise in writing, fees are payable in full before teaching begins.
- A registration fee may be charged at enrolment. It is separate from tuition.
- Tuition covers teaching, assessment and the learning materials listed for the programme.
- Awarding-body fees — registration, examination, certification or membership fees payable to ICM, AHLEI, Qualifi, Highfield, IATA or KHDA — are charged at the rate the body sets. Where that rate changes, the change applies to registrations not yet made.
- Re-sit, re-assessment, replacement certificate and courier charges are published separately and are payable when the service is requested.
Card payments are taken through the facility described on online payment. We do not receive or store your card details.
Where fees are unpaid, we may suspend access to teaching, withhold assessment results, and decline to register you with an awarding body until the account is settled.
4. How teaching is delivered
Programmes are taught online, or blended — online study combined with in-person sessions hosted at the premises of an affiliate institute. Each programme page states which applies. Where in-person sessions form part of a programme, the venue, the schedule and the number of sessions are confirmed to you before the programme begins.
Online delivery is through the learner platform. You are responsible for your own internet access and for a device that meets the stated requirements.
5. Changes to a programme
We may change a timetable, a venue, a tutor, an assessment date or the order in which material is delivered. Where a change is material — a change to the qualification awarded, to the mode of delivery, or to the total number of taught hours — we will tell you in writing, and you may withdraw with a full refund of tuition for the part not yet delivered if the change is not acceptable to you.
We may cancel a cohort that does not reach its minimum enrolment, or that cannot run for reasons outside our control. If we cancel, you may transfer to the next available intake at no charge or take a full refund, including the registration fee. This is set out in the cancellation and deferral policy.
6. Attendance, assessment and progression
Awarding bodies set minimum attendance and assessment requirements, and we are obliged to apply them. Failure to meet them may mean you cannot be entered for assessment, or cannot be certificated, and does not create a right to a refund.
Assessment is governed by the awarding body’s rules on submission, re-sits, extenuating circumstances, appeals and academic misconduct. Those rules, not these terms, decide assessment outcomes.
7. Materials and intellectual property
Course materials, recordings, assessments and platform content are licensed to you for your own study for the duration of your programme. They may not be copied, shared, resold, uploaded or used to deliver training to others.
Digital materials and eBooks supplied under licence — including Highfield publications — are issued to you personally. Once access has been issued, that licence cannot be returned or transferred.
8. Conduct
We expect professional conduct toward staff, tutors, fellow students and the staff of any host venue. We may suspend or exclude a student for harassment, for conduct that endangers others, for academic misconduct, or for conduct that puts our relationship with an awarding body or a host venue at risk. Exclusion on these grounds does not create a right to a refund.
9. Your personal data
How we collect, use and keep your information is set out in the privacy statement. Where an awarding body requires your details in order to register you for a qualification, we pass them to that body for that purpose.
10. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, our total liability arising from your enrolment is limited to the fees you have paid for the programme concerned. We are not liable for indirect or consequential loss, including loss of earnings, loss of an employment or visa opportunity, or loss arising from an awarding body’s decision on your assessment or certification.
We do not guarantee employment, a particular grade, or admission to any further programme or institution.
11. Complaints
Tell us first: write to [email protected] setting out what has happened and what you would like done. We acknowledge complaints within five working days.
Complaints about an assessment decision follow the awarding body’s appeals procedure. Complaints we cannot resolve may be raised with KHDA.
12. Changes to these terms
We may update these terms. The version that applies to you is the one published when you enrolled; the date at the top of this page says when it last changed. A change that affects students already enrolled will be notified in writing.
13. Governing law
These terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, and the courts of Dubai have jurisdiction. Nothing here affects your rights under UAE consumer protection law.
